Algarve Sports Ltd Terms and Conditions

These conditions set by Algarve Sports will not affect your statutory rights and are subject to English law and the exclusive jurisdiction of the courts in England, Wales & Scotland.

  1. Your Booking.

Algarve Sports Ltd is a company committed to customer satisfaction and consumer financial protection. We are therefore pleased to announce that, at no extra cost to you, and in accordance with ”The Package Travel, Package Tours Regulations 1992” all passengers booking with Algarve Sports Ltd are fully insured for the initial deposit, and subsequently the balance of monies paid as detailed in your booking confirmation form. The policy will also include repatriation if required, arising from the cancellation or curtailment of your travel arrangements due to the insolvency of Algarve Sports Ltd.  This insurance has been arranged by Towergate Chapman Stevens through Zurich Insurance PLC.

In the unlikely event of Insolvency, you must Inform Towergate Chapman Stevens immediately on +44 (0) 1932 334140 or by email at tcs@towergate.co.uk . Please ensure you retain the booking confirmation form as evidence of cover and value.

Policy exclusions: This policy will not cover any monies paid for Travel Insurance or any claim relating to Air Flights. Please ensure the Company you have booked with has the appropriate CAA / ATOL Bonds in place.

  1. Travel Documents.

All relevant passports, visas and health documentation are your responsibility. If you are refused travel entry into a country because of documentary irregularities Algarve Sports Ltd will not be held liable.

  1. Changes made to your booking.

In the unlikely event any changes are made to your booking these will usually be very minor, however, you will be informed immediately by e-mail or telephone.

Sometimes things happen which are outside of our control, if such a thing means a major change to your holiday we will contact you immediately and do everything we can to resolve the issue to your satisfaction.

  1. Personal Holiday Insurance.

Algarve Sports Ltd acts purely as an agent and therefore arranging your holiday insurance is your responsibility. We are not responsible for arranging this and our products/services do not include insurance cover. This must be organised separately.

  1. Deposits and Cancellations.

A 20% non-refundable deposit is payable immediately to secure your booking, the balance of the holiday must then be settled no later than 30 days prior to travel. If you are making payment via cheque or bank transfer please be mindful of the clearance time.

In the unfortunate event that you need to cancel your booking this must be done by e-mail to Phil@algarvesports.co.uk at your earliest convenience.

  • If you cancel your booking up to 30 days prior to the travel date you will be refunded in full less your 20% deposit.
  • If you cancel your booking less than 30 days before the travel date no refund will be given.
  • If payment is not received by the due date, we will cancel the booking and no refund will be offered.

Regardless of the amount of persons travelling Algarve Sports will always quote for the holiday inclusive of all guests. Following booking if any individual decides not to travel the cost of the holiday will remain the same and must be paid in full. (I.e. There will be no deductions made if less people travel than initially booked) However in such circumstances if a replacement can be found Algarve Sports will amend the booking and make the relevant name changes at no further cost to yourself. (Please note changing names with airlines etc will remain your responsibility)

In some cases, cancellation fees may be recovered under the terms of your holiday insurance.

If you decide to vacate the accommodation prior to the expiry of the holiday, Algarve Sports will not offer a refund.

We reserve the right to cancel your holiday. In the unlikely event that we do, you will be offered the choice of a full refund or a holiday of comparable standard.

Algarve Sports predominately deals in Euros meaning that our prices, when converted to GBP, are always subject to fluctuation. For customer convenience we offer several ways to make payment, when you have decided which best suits you this must be confirmed on e-mail to ourselves at Phil@algarvesports.co.uk. If you would like to discuss these options further please do not hesitate to contact us.

Payment in full at time of booking – Payment will be made based on the exchange rate at the time of booking.

Fixed price – Algarve Sports will provide a price (in GBP) for your holiday based on the exchange rate at the time of booking, we will then guarantee that price for you. Please note the 20% booking fee still applies at booking along with the balance being due 30 days before travel.

Variable Price – Algarve Sports will provide an estimated price (in GBP) for your holiday based on the exchange rate at the time of booking, however you will then be able to make payment for your holiday at any time up to 30 days before travel. It is your responsibility to monitor the exchange rate, if during this time the overall cost of your holidays increases with the exchange rate you are liable for the difference. Of course it may also fall which is why we offer this option. Please note the 20% booking fee still applies.

When paying for your holiday we have two methods of payment:

  1. Making a Complaint.

At Algarve Sports we want you to be 100% satisfied with the service you receive and your holiday, however if you feel the need to make a complaint please contact us directly.

We will always do our best to ensure customer satisfaction.

If you have a complaint directly related to the resort, again please feel free to contact us first and we will endeavour to resolve the problem. Alternatively, if you feel it is something that the resort are better equipped to deal with – and a matter that is beyond our control – then please contact the General Manager.

All airport transfers booked through Algarve Sports are only made after we have received confirmation of your flight times, all monies are payable to the transfer company upon arrival. If your flight times change it is your responsibility to inform us in order for us to change your transfer times. Failure to do so may result in extra charges that we cannot be held liable for.

  1. Car Hire.

Algarve Sports Ltd acts as an agent for car hire and therefore will not be held responsible or liable for any loss, damage or injury caused. The contract you sign will be with the hire company and therefore you must adhere to their terms and conditions.

  1. (Resorts/Hotel/Facilities)

Algarve Sports will always endeavour to provide you with descriptions that are up-to-date and correct at the time of publication. Any images that we use on our website and literature are there to give you a general idea. We are fully aware that things can change but we cannot accept responsibility or liability for things that are beyond our control.

On occasions you may find there are changes being made, redevelopment’s taking place and building work taking place, however, we will not select accommodation where such disruption is likely to affect your holiday. Algarve Sports Ltd reserves the right to substitute alternative accommodation of the same or superior standard in the same resort should this become unavoidable.

Algarve Sports Ltd will not be held responsible for any errors or changes from the time of publication.

  1. Behaviour Policy.

If Algarve Sports is made aware that an individual’s or individuals in your party are causing disruption or damage to property, we reserve the right to terminate the booking and therefore accommodation. In this circumstance no refund will be given.

  1. Course Conditions. (Golf Only)

Prior to your departure Algarve Sports Ltd will endeavour to find out the condition of the golf courses. However, we will not be held responsible for the actual playing conditions of the golf courses whether caused by course maintenance, or weather conditions etc.

We will never select golf courses which are due for any major changes or maintenance.

If you find that the golf course is closed due to bad weather conditions, this will be at the discretion of the golf course. However, if you have concerns over the course conditions please e-mail us: Phil@algarvesports.co.uk or telephone us on +0044 7525 749336.

  1. Handicap Certificates. (Golf Only)

At some resorts handicap certificates must be produced prior to play so we recommend that you take a certificate with you, however we tend to find that this is very rare. Alternatively, if it is more convenient please e-mail us proof of your handicap and we will forward this onto the resort.

  1. Dress Code. (Golf Only)

Most resorts will adopt a strict dress code which must be adhered to. These generally include:

  • Soft spikes only (metal spikes are not allowed)
  • T-shirts, jeans, trainers and beach shorts are not permitted on the golf courses
  • Shirts with collars and golf trousers/tailored shorts must be worn at all times (by players and guests).
  1. Green Fees. (Golf Only)

Cancellation of confirmed times may incur cancellation charges up to the value of the pre-paid green fee, subject to the cancellation policy of the course involved. Golf Clubs reserve the right to make up matches to 4 balls. Whilst Algarve Sports Ltd will endeavour to meet requests for specific courses, days and times, these are subject to availability and we cannot guarantee we can meet them. Accordingly, requests are not binding on us.

  1. Starting Times. (Golf Only)

On very rare occasions it may be necessary for the resort to to change your starting time. However, if this is the case you will be informed in advance. All starting times are considered as “4 balls”, formations will be grouped accordingly.

  1. (Go Karting)

Algarve Sports Ltd acts as an agent when making reservations for a range of activities and therefore will not be held responsible or liable for any loss, damage or injury caused.

Each reservation made by Algarve Sports Ltd will be made in accordance with the company’s terms and conditions, which must be respected.

Go Karting Terms & Conditions.

  • It is obligatory that all the participants be on circuit at least 15 minutes before the beginning of the Race.
  • If the Client does not respect the 15-minute rule, the Management of the Kart racing track reserves the right to deduct this time from the total race time.
  • In the case of technical breakdown, the go-Kart will be substituted, except when the breakdown is caused by an accident and the repair time is longer than that left to finish the race.
  • The Management reserves the right to exclude any participant, at any point during the race, if he/she behaves inappropriately, drives dangerously, or disrespects instructions made by the staff of the Kart race track. In this case the participant will lose all rights to any refund.
  • Our civil responsibility insurance policy from AXA covers any client victim of an accident within the park enclosure or whilst go-karting on circuit.
For under-18 year olds, parents or guardians of legal age must sign a waiver of responsibility (available from the Management of the Kart racing track).
  • If the client does not comply with the timetable of the race, the Management reserves the right to cancel or reduce the duration of the race.
  • In case of wet weather, the company, following safety norms, reserves the right to delay the race or if this is completely impossible cancel the race refunding the value already paid.
On circuit real time information on weather predictions is available.
  • If there is an interruption because of the weather during the race this may be postponed and if postponement is impossible the value refunded will be based on the percentage of time passed (if the race was planned for an hour and interrupted after 30 minutes, then the refund will be 50% of the race).
  • We have special go-karts equipped with hand controls on the steering wheel for the paraplegic (contact us for more information).
  • The track also provides protective gear in case of rain, and the go-Karts are also equipped for wet conditions.
  • If the equipment is damaged by causes attributed to the Client, then he/she will have to pay for the value of each piece of equipment (contact us to find out the current value).
  • The Circuit reserves the right to not accept or expel any driver that shows psychic anomalies, for instance alcohol, without any kind of refund.

  1. (Water-sports)

Algarve Sports Ltd acts as an agent when making reservations for a range of activities and therefore will not be held responsible or liable for any loss, damage or injury caused.

Each reservation made by Algarve Sports Ltd will be made in accordance with the company’s terms and conditions, which must be respected.

Watersports Terms & Conditions

  • You must check in at least 15 minutes before your departure time
  • If a cancellation occurs due to adverse weather conditions or mechanical failures, an alternative day and time will be offered according to your convenience
  • If mechanical failure occurs at sea – and is not repairable – another time slot will be offered or discount on another activity
  • If you do not bring the deposit for the jet-ski you will not be allowed to ride
  • If you damage a jet-ski or fail to abide with the rules and regulations, you will lose your deposit
  • For safety reasons we strongly advise that expectant mothers or anyone suffering neck/back problems do not ride
  • All excursions are licensed by the Portuguese Tourism Board

Cancellation of Activities.

In case of cancellation, we must be informed at least 14 days before the activity in order to receive a full refund, or change to another activity. If less than 14 days, no refund will be given.

  1. Cancellation of Flights.

If your flight is cancelled or delayed due to unforeseen circumstances by the airline, Algarve Sports Ltd will do their best to reschedule all bookings. All re-bookings will be subject to resort availability and any costs incurred will be for the client to pay and may be recoverable through your holiday insurance or airline carrier.
